Your permissible purpose is:     Contract Details SERVICE AGREEMENT, entered into as of today's date by and between kerntenantscreening.com, Inc. and the undersigned (herein after called "Subscriber"). 1. That the Subscriber employs kerntenantscreening.com, Inc. to obtain and upon request, to furnish for the Subscriber's use and benefit. Information concerning specifically the individual's resident history, including; rental payment habits, any returned checks, apartment upkeep, proper notice given to move (were the rules of the lease abided by?), broken leases, evictions, pets (if so, how many), general character (would they rent to them again?), verification of employment, income range, credit history information, and criminal convictions. 2. Subscriber agrees to request information only for the Subscriber's exclusive use, and the Subscriber certifies that inquiries will be made only for permissible purposes, namely for use in determining the propriety of writing a lease. Reports on Employees will be requested only by the Subscriber’s designated representative. Employees will be forbidden to attempt to obtain reports on themselves, associates, or any other person except in the exercise of their official duties. Subscriber agrees to have applicant sign an application form explicitly giving permission to pull applicants credit report. (The Fair Credit Reporting Act provides that any person who knowingly and willfully obtains information on a consumer from a consumer reporting agency under false pretenses shall be fined not more than $5,000 or imprisoned not more than one year, or both.) Subscriber must have a signed release before requesting service. 3. Subscriber further agrees to keep all signed releases on file for a period of 3 years and to provide any signatures upon request to kerntenantscreening.com, Inc., Inc. 4. Subscriber agrees that while kerntenantscreening.com, Inc. shall be required to use good faith in attempting to obtain reliable and accurate information from sources deemed reliable, kerntenantscreening.com, Inc. shall not be held liable in any manner whatsoever for any loss or injury to Subscriber resulting from the obtaining or furnishing of such information, whether written or verbal; and further, that Subscriber agrees to hold kerntenantscreening.com, Inc. and its officers or employees, jointly and severally, harmless and indemnify them from any and all claims, losses of damages arising out of alleged liability or failure of the Subscriber to keep and perform any of its obligations describer herein. 5. Subscriber agrees to pay kerntenantscreening.com, Inc. upon receipt of statement for the services rendered during the previous 30-day period according to the current rate schedule in effect. If Subscriber fails to pay the statement for services rendered upon receipt of statement Subscriber shall be liable for and shall pay a late fee of $25.00, and 18% per annum in interest of the unpaid balance 30 days from the date of statement. Returned check charge is $25.00. Subscriber is responsible for payment on all requests submitted to kerntenantscreening.com, Inc., whether applicant leases the property or not. Do not submit request to the office unless you are prepared to pay for it. All fees are nonrefundable once submitted into our office and reports are processed. 6. This Agreement shall continue in force without any fixed date of termination, but either kerntenantscreening.com, Inc. or Subscriber my terminate the Agreement upon thirty (30) days prior notice to the other. It is further agreed, however, that with just cause, such as delinquency or violation of the terms of the contract, kerntenantscreening.com, Inc. may upon its election discontinue serving the Subscriber and cancel this contract immediately by written notice to the Subscriber. The parties hereto agree that this instrument is the full and complete agreement between them and shall not be altered, varied or enlarged upon by any verbal promises, statements, or representations not expressed herein. This agreement shall not be binding on either party until accepted by kerntenantscreening.com, Inc. and its officers. Notice of User Responsibilities Attachment 'B' To kerntenantscreening.com, Inc. Appendix B to Part 601 Prescribed Notice of User Responsibilities This appendix prescribes the content of the required notice. NOTICE TO FURNISHERS OF INFORMATION: OBLIGATIONS OF FURNISHERS UNDER THE FCRA The Federal Fair Credit Reporting Act (FCRA), as amended, imposes responsibilities on all persons who furnish information to consumer reporting agencies (FCRAs). These responsibilities are found in Section 623 of the FCRA. State law may impose additional requirements. All furnishers of information to CRAs should become familiar with the law and may want to consult with their counsel to ensure that they are in compliance. The FCRA, 15 U.S.C. 168d1lu, is set forth in full at the Federal Trade Commission's Internet web sit (http://www.ftc.gov). Section 623 imposes the following duties: General prohibition on reporting inaccurate information: The FCRA prohibits information furnishers from providing information to a consumer reporting agency (CRA) that they know (or consciously avoid knowing) is inaccurate. However, the furnisher is not subject to this general prohibition if it clearly and conspicuously specifies an address to which consumers may write to notify the furnisher that certain information is inaccurate. Sections 623(a)(1)(A) and (a)(1)(C) Duty to correct and update information: If at any time a person who regularly and in the ordinary course of business furnishes information to one or more CRAs determines that the information provided is not complete or accurate, the furnisher must provide complete and accurate information to the CRTA. In addition, the furnisher must notify all CRAs that received the information of any corrections, and must thereafter report only the complete and accurate information. Section 623(a)(2) Duties after notice of dispute from consumer: If a consumer notifies a furnisher, at an address specified by the furnisher for such notices, that specific information is inaccurate, and the information is in fact inaccurate, the furnisher must thereafter report the correct information to CRAs. Section 623(a)(1)(B) If a consumer notifies a furnisher that the consumer disputes the completeness or accuracy of any information reported by the furnisher, the furnisher may not subsequently report that information to a CRA without providing notice of the dispute. Section 623(a)(3) Duties after notice of dispute from consumer reporting agency: If a CRA notifies a furnisher that a consumer disputes the completeness or accuracy of information provided by the furnisher, the furnisher has a duty to follow certain procedures. The furnisher just: Conduct an investigation and review all relevant information provided by the CRA, including information given to the CRA by the consumer. Sections 623(b)(1)(A) and (b)(1)(B) Report the results to the CRA, and, if the investigation establishes that the information was, in fact, incomplete or inaccurate, report the results to all CRAs to which the furnisher provided the information that compile and maintain files on a nationwide basis. Sections 623(b)(1)(C) and (b)(1)(D) Complete the above within 30 days from the date the CRA receives the dispute (or 45 days, if the consumer later provides relevant additional information to the CRA). Section 623(b)(2) Duty to report voluntary closing of credit accounts: If a consumer voluntarily closes a credit account, any person who regularly and in the ordinary course of business furnishes information to one or more CRAs must report his fact when it provides information to CRAs for the time period in which the account was closed. Section 623(a)(4) Duty to report dates of delinquencies: If a furnisher reports information concerning a delinquent account placed for collection, charged to profit or loss, or subject to any similar action, the furnisher must, within 90 days after reporting the information, provide the CRA with the month and the year of the commencement of the delinquency that immediately preceded the action, so that the agency will know how long to keep the information in the consumer?s file.
